  2. A description of the material that has been removed or to which access has been disabled and the location where it appeared before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. A statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who provided the original DMCA notice.
  5. Your physical or electronic signature.

5. Removal or Disablement of Access

Upon receiving a valid DMCA Notice of Copyright Infringement, DelishDiscover will:

  1. Expeditiously remove or disable access to the infringing material.
  2. Notify the user who posted the material that it has been removed or access disabled and inform them of your right to file a counter-notice.

6. Repeat Infringer Policy

In accordance with the DMCA and applicable law, DelishDiscover will terminate, in appropriate circumstances, users who are deemed to be repeat infringers. A repeat infringer is a user who has been notified of copyright infringement and has been removed or had access to their content disabled for infringing material on three or more occasions.

7. No Liability for User-Generated Content

DelishDiscover is not liable for user-generated content posted on the Site. We do not have actual knowledge of the infringement and are not aware of facts or circumstances from which infringing activity is apparent. Upon obtaining proper notification of infringement, we will act promptly to remove or disable access to the infringing material.

8. Good Faith Belief and Accuracy

By submitting a DMCA notice or a counter-notice, you represent that:

  • You have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • The information in the notice is accurate, and under penalty of perjury, you are authorized to act on behalf of the copyright owner.
